This week we're doing things slightly out of order. Instead of show 39, show 40 is going up because of the Virginia Tech shootings that happened here in the States. While this show topic is not limited to school shootings, it does cover some of our thoughts on these insane occurrences. Show 39 will go up next week, but for now Show 40 covers what Lando and I both see as an increasing trend in the US to shield ourselves from the very real dangers and stresses of everyday life. Does it really do us any good to pretend that bad things don't happen, that failure is insignificant, or that we can sue our way out of  responsibility? Is our general reluctance to accept consequences for our actions just a smokescreen as we try to Jekyll our way out of seeing Hyde in the mirror? And what impact will this have on the future?

Hey Nate,

Great question. In New York anyway, the city does own the sidewalk and in the past had been the party to sue, but that changed as of September 2005. The property owner is now legally obligated for maintenance and any injury sustained. Go the this address for an article about the issue:

Cool show guys. I have a comment though. Your statement that serial killers are mainly american is not quite true. I would research the topic more. For example, Pedro Alonso Lopez, was a serial killer in South America who murdered 300+ people. We just don\'t hear about serial killers outside of america because they are not as well documented, and americans generally don\'t care if it\'s not in their country.

I don\'t get the litigous culture that seems to have come about in the materialist, me me me, age.

A friend of mine fell down the stairs at high school and fractured his collar-bone, I fell off playground equipment in primary school and broke my arm. In the first year of high school some asshole bully snatched a pair of scissors out of my hand that I was passing to a friend (blades in hand as they always tell you) and they opened and sliced open my palm.

Not only were there no law-suits for any of these events, there was never the thought of any kind of legal action or even blaming the school for shit that just happens.

Synchronicity (VT) of this episode was chilling. You have an eye for the state of our culture... which is why I enjoy the show.

Like Illusive Mind, I too grew up on an elementary school jungle gym that towered over the asphalt like scaffolding left over from a failed North Korean building project.

I encounter the new sheltered youth daily. Interesting that they are so easily shocked or offended by the world around them. Being twice their age - I thought it was supposed to be the other way around.

I\\\'ve just got one question for anyone who wants to answer. In the example of someone can sue you for tripping on your sidewalk or slip on the ice on your sidewalk. The way I understand it, the sidewalk is actually city property, so wouldn\\\'t the case only be good for suing the city? On top of that, if they can legally sue you, doesn\\\'t that mean that the sidewalk is your private property. Therefore couldn\\\'t you put signs up saying no one is allowed to walk on your section of sidewalk? Or a sign that exonerates you for any injuries someone may get from walking on it?
